I want to just comment on your question # 1.

The way I understand it is that data driven lsp bindings are permitted.
Nothing prevents anyone from coming up with a architecture where the MPLS
labels can b
e learnt based on the data  instead of a control setup. If I remember right,
long ago (1996) there was some RFCs written by folks from Ipsilon
Networks(now part of Nokia) which dealt with data driven label setup instead
of using a explicit control path setup. Check RFC 1953, 1954 and other
related RFCs for more information.
